What I do on my farm in Fillmore Co...↓unty does affect the water quality and quantity for everyone, not just us on this farm. And farming on the karst geology makes my farming practices even more important for the protection and clean up of water for drinking (people and livestock), fishing, bathing, recreation and cooking.

As a farmer, I understand the fear and frustration of having more regulations for my business to implement and follow. They may add cost and burdensome time needs. However, any business should be careful with or water, and fully aware of how that business uses and changes the water before it is put back into the water cycle. And the bigger the water use, the more that water use should be checked on and overseen. When businesses - manufacturing or farming - pollute and mismanage the water they use, I am in favor of enforcing actions such as huge fines and/or permit withdrawals and shutting down the business.

I support the new changes proposed for protecting our shared groundwater. Using cover crops, incorporating manure, visual inspections water sampling, and having consistency in regulations on spreading or buying manure, as you propose, are all good to implement.

In addition, where nitrate contamination is rising, limiting the number of permitted feedlots in the region should be considered. For example, Ten 1,000 a.u. CAFO's within a 5 township area can be as bad or more risky than one 10,000 a.u. in the same 5 townships. And perhaps this regional consideration, be it townships, county, or group of counties such as our karst region, or the sands in central region needs additional regulation considerations even if the nitrates are not increasing. The 10 ppm of nitrate level was set with the best intentions years ago. As we learn more, it may be higher than is prudent, especially since more and more studies are showing more health issues and also, there is often other contaminants in the water if nitrates are there. Manure application anywhere should get basic attention, and especially when a business is spreading over many acres.

Record keeping that involves protecting water for all should not be secretive. Extensive water testing and monitoring before, during and after construction of a C.A.F.O. should be done.

This all may seem "too much". However, considering the ways and places water moves, and how tough it is to clean up the aquifers once they are contaminated, I believe it is extremely important that we monitor and protect or water. Our bodies are over 70% water and our planet earth's surface is close to 80% water (percentages may hot be accurate). I think we need to be careful and wise with our water usage and minimize the pollutants already in us and our environment. A raindrop may travel many places after sliding down my cows belly in the pasture (we rotationally graze). Perhaps it goes in the ground to the aquifer that my neighbors well brings up water for their C.A.F.O., and then the water drop gets drank by their cow, peed into the slurry, pumped onto the hillside. Hopefully, this water drop can stay in the soil, but it could slide into a sinkhole, or a stream or Donaldson Creek, and flow into the Root River, then the Mississippi River, then the Gulf of Mexico. Anywhere along those areas, it may find a crevice and travel into one of the ground water aquifers.

Please do not hesitate to make and enforce protective regulations for C.A.F.O.'s using our water.
Truly, Farming is Everybody's Bread, Butter, and Water. What I do on my hills affects the water quality and quantity for Everyone.

The North Star Sierra...↓ Club (NSSC) is a nonprofit organization and leading grassroots voice for volunteer leaders. Improved manure best management practices, monitoring, and reporting can assist with the concerns for nitrate contamination in drinking water and prevent human health impacts including some cancers, birth defects, and pregnancy complications in Minnesota. Our comments are:

1. We agree with the proposed feedlot permit changes including a) manure application in the spring or planting cover on the land when manure is provided, b) incorporating manure into the soil when applied on a floodplain, c) inspections during and after manure application to assess any runoff, d) reinspection if it rains soon after application of the manure to the land surface if manure is not incorporated, and e) reporting any discharge of manure to the Minnesota Duty Officer, f) farmers who receive manure from feedlots must follow the conditions on manure management contained in the permit of the facility they purchased the manure from.

2. In addition, we recommend the following changes to further prevent nitrate contamination in surface and groundwater due to manure storage and application. Our recommendations include the need for monitoring and reporting on efforts to prevent this pollution.

a. The manure application requirement options for October, November, and the winter should be required on all lands in Minnesota where manure is applied.
b. Reporting by permit holders demonstrating compliance with feedlot permit conditions should be improved and adhered to, and this information should be made readily available to the public.
c. Feedlot permits should require water quality monitoring plans designed for their facility and lands where manure is stored and applied and approved by the MPCA. This should include where and when sampling will be done, and which parameters are to be measured. To establish a baseline, water quality monitoring should be completed before facility construction or manure has been applied and consistently thereafter.
d. Documentation of all inspections must be maintained and submitted to the MPCA on a required periodic basis.

I am glad to see some of the changes and updates that the agency has proposed for the new NPDES and SDS permits. Many of them are commonsense ways to protect our shared land, water, and c...↓ommunities from the harmful effects of CAFOs, and I want to share my support for these changes including:

– Protecting our shared groundwater by requiring that by 2028, all lands that have manure applied to them in vulnerable groundwater areas must have either a growing crop, a perennial crop planted, or have a cover crop planted with 14 days of manure application if spreading in October and November. I also support phasing out winter application entirely in these areas.

– Protecting surface waters by limiting manure application within a 100-year floodplain to only application that incorporates the manure into the soil.

– Monitoring spreading by requiring the permit holder do visual inspections of all land application areas.

– Helping with cleanup and accountability by requiring the permit holder do water sampling after a manure discharge event.

– And making our rules consistent by requiring people who buy manure from a permit holding operation or spread manure for one follow the permit requirements.

These new changes are a good start to what must be done to keep people and our shared water and land safe, but they also leave quite a bit of room for improvement. Here are some changes to your proposed permit that I think would make it stronger and would bring it closer to what people like me and my neighbors need:

– While protecting water sources in Minnesota's vulnerable groundwater areas is particularly important, all Minnesotans, regardless of where they live, deserve to have access to clean water. The additional requirements to the October, November, and winter applications of manure in vulnerable groundwater areas are good, commonsense management practices, and the requirement that those practices be followed should be extended to all lands where manure is applied.

– While it is good that record-keeping of applications, including water sampling and ensuring that manure buyers are following permit rules, will be required to help make sure that permits are being followed, there needs to be a more robust requirement for permit holders to share this information with the agency so they can ensure permits are being followed. In addition, this information should be made available to the public. Communities that are at risk of CAFO pollution and its effects deserve to know that permits are being followed. Making this information publicly available will also allow community members to help the agency ensure that permit requirements are being met.

– In addition to water sampling and testing being done after a discharge event, this permit should require more proactive water samplings to ensure long-term compliance with the permit and to help ensure accountability. These permits should require water sampling and testing be done regularly around the permit holding site and where liquid manure from the site is being spread so that the agency and the public can know that long-term damage and contamination is not occurring. These permits should also require that new constructions of manure basins and new lands used for spreading must undergo water sampling and testing before construction begins or manure is spread to establish a baseline nutrient load for future testing to be measured against.

I am encouraged by the steps the agency has taken to strengthen Minnesota's NPDES and SDS permits to help keep us, our communities, and our shared water and land safe. I hope that you can continue these steps and incorporate some of the much-needed changes I have shared here into your new permits. Let's make these new permits something that will protect all Minnesotans.

In regards to Page 2 of the June 2024 form "wq-f3-55", MPCA says "More than 70% of the nitrate in Minnesota waters comes from cropland". I challenge that, and I do not accept it as fact. Science does not yet have all the answers when it comes to Ka...↓rst topography and the water flow between aquifers. "Since 1989, when new well standards came into place, only .03% of those newer wells have contamination problems" - Ross Dunsmoor, a Winona County employee as quoted in June 2024. Older wells were drilled as shallow as possible in order to save landowners money. Well casings were also very shallow, or nonexistent. Those countless older wells contribute nitrates to the deeper aquifers and they need to be identified and properly sealed. The City of Altura recently sealed one of their old shallow wells early in 2024. Prior to sealing, the Winona County SWCD partnered to send a camera down the well shaft to document water flow. Their observations proved that high-nitrate water was flowing in large volumes from the more shallow aquifer (with high nitrates) into the deeper aquifer (with historically low nitrates). There are countless older shallow wells in southeastern Minnesota similar to the City of Altura. What does science say about their level of contribution to nitrate levels? The City of Altura had a sewer treatment pond collapse in the 1980's or 1990's. Hundreds of thousands of gallons of raw sewage entered the groundwater. The City of Lewiston had a total sewer pond failure where the high-nitrate liquid disappeared into a sinkhole overnight also in the 1980's or 1990's. More than one million gallons of raw sewage entered the groundwater. What does science say about their contribution to nitrate levels? Proposed new regulations will require additional manure storage, which is extremely expensive. Will there be additional funding for cost share monies to help producers comply? "USDA forecasts 2024 net farm income to drop 25.1% from 2023. That follows a 16% decline from 2022 to 2023.
