Cumulative impacts community benefit agreements
The MPCA has begun work to implement a groundbreaking new law to remedy Minnesotans’ disproportionate exposure to pollutants. The law defines environmental justice areas and requires the MPCA to conduct a rulemaking process to address the cumulative impacts of pollution during permitting processes.
On August 14, 2024, the MPCA held the next working session in a series for the cumulative impacts rulemaking. This working session focused on developing the different components of the community benefit agreement process that will actively engage and encourage affected residents to participate in developing agreements unique to their neighborhoods that will become legal and enforceable contracts between the MPCA and the permittee. The purpose of the work session and this opportunity for public input is to begin the process of co-creating a process and identifying what benefits to consider for these agreements. Initial proposed processes and benefits are based on:
research into how other states have implemented community benefit agreements or similar agreements
findings from a review of what benefits and elements have been included in community benefit agreements or similar agreements
information gathered from the Cumulative Impacts Conversation: Community Benefit Agreements co-learning webinar
Future working sessions and public comment periods will focus on other parts of the rule.
