Cumulative impacts analysis requirements
The MPCA has begun work to implement a groundbreaking new law to remedy Minnesotans’ disproportionate exposure to pollutants. The law defines environmental justice areas and requires the MPCA to conduct a rulemaking process to address the cumulative impacts of pollution during permitting processes.
On Sept. 19, 2024, the MPCA held the next working session in a series for the cumulative impacts rulemaking. This working session focused on determining when the MPCA should require a cumulative impacts analysis. The purpose of the work session and this opportunity for public input is to co-create a process and identify what benchmarks to consider for requiring these analyses. Benchmarks could be criteria or other information that is considered and measured against a defined metric in determining the need for a cumulative impacts analysis.
Proposed processes are based on:
• what we’ve heard from comments and from you in previous discussions
• research into how other states have implemented similar cumulative impacts analysis programs
• findings from a review of Minnesota-programs that use benchmarks to determine when an analysis or review is required
