Draft concepts for the cumulative impacts analysis rules

The MPCA is working to implement a groundbreaking new law to remedy Minnesotans’ disproportionate exposure to pollutants. The law defines environmental justice areas and requires the MPCA to conduct a rulemaking process to address the cumulative impacts of pollution during permitting processes.  


On June 25, 2025, the MPCA held a virtual opportunity to discuss and provide input on the draft concepts for the cumulative impacts analysis rules. During the meeting, the MPCA shared the draft rule concepts we’ve prepared to meet the requirements in Minn. Stat. 116.065. The statute requires the MPCA to adopt rules to implement and govern cumulative impact analyses and the issuance or denial of permits for facilities that impact environmental justice areas in the Twin Cities, Rochester and Duluth. 


We are seeking your input on our draft rule concepts as we continue to develop the rules for cumulative impacts analyses before issuing a notice of intent to adopt the rule in May 2026. These concepts are preliminary and may or may not occur. These concepts are not final.

When a CI Analysis is required: The MPCA is considering comparing each individual environment stressor to the county or state median for that stressor. The total number of stressors above that median would then be compared to the median number of stressors above the median in the county or state, excluding environmental justice areas. Facilities in environmental justice areas with the number of stressors above the median of the county or state would be required to do a cumulative impact analysis. Should the degree above the median for each environmental stressor, or for the total number of environmental stressors, affect which facilities are required to complete a cumulative impact analysis? Is there a threshold at which any one environmental stressor should trigger a cumulative impact analysis? Why, or why not? (Refer to presentation slide 17)

Petition Process and Material Evidence: The MPCA is considering basing the petition process for this rule on the existing Environmental Review petition process. These rules govern how to evaluate a petition by considering information such as the type, extent, and reversibility of effects and if those effects are mitigated or controlled by other actions. What criteria do you think MPCA should use to evaluate a petition and determine if a cumulative impacts analysis is needed? (Refer to presentation slide 20).
