Draft concepts for the cumulative impacts analysis rules
The MPCA is working to implement a groundbreaking new law to remedy Minnesotans’ disproportionate exposure to pollutants. The law defines environmental justice areas and requires the MPCA to conduct a rulemaking process to address the cumulative impacts of pollution during permitting processes.
On June 25, 2025, the MPCA held a virtual opportunity to discuss and provide input on the draft concepts for the cumulative impacts analysis rules. During the meeting, the MPCA shared the draft rule concepts we’ve prepared to meet the requirements in Minn. Stat. 116.065. The statute requires the MPCA to adopt rules to implement and govern cumulative impact analyses and the issuance or denial of permits for facilities that impact environmental justice areas in the Twin Cities, Rochester and Duluth.
We are seeking your input on our draft rule concepts as we continue to develop the rules for cumulative impacts analyses before issuing a notice of intent to adopt the rule in May 2026. These concepts are preliminary and may or may not occur. These concepts are not final.
Please review the meeting presentation which contains the draft rule concepts by clicking the “Review documents” button below. We are seeking feedback on many questions in the following categories of the rule:
When a CI analysis is required (questions 1-6)
Petition process and materials evidence (questions 7-11)
CI analysis contents (questions 12-17)
Substantial adverse impacts (questions 18-23)
Tribal considerations (questions 24-25)
Public participation requirements (questions 26-28)
Community benefit agreements (questions 29-34)
Please give input where you have it and feel free to leave questions blank where you don't have any feedback. You are able to move between the questions below without having to submit an answer to each question. Some questions will refer to items in the attached PowerPoint presentation. Please also feel free to submit input in more than one sitting as answers to questions cannot be saved and submitted all at once. Answers need to be written and submitted at the same time.
Also attached is a PDF containing a set of graphics that will walk you through the draft cumulative impacts process. These are meant to be used as a reference guide.
