The purpose of this rulemaking is to establish new rules for air toxics emissions reporting requirements for facilities located in the Twin Cities metro area, except option B registration permits, as directed by Minn. Stat. § 116.062. This rule will establish which facilities are required to report, reporting frequency, methods to measure or estimate air toxics emissions, and the pollutants required to be reported. Additionally, certain sections of chapter 7007 that allow a Title V air permittee to assert emergency affirmative defense are proposed to be repealed following the Environmental Protection Agency’s repeal of these provisions from the Clean Air Act. The Minnesota Pollution Control Agency has drafted a rule concept summary and seeks input before the MPCA issues its notice of intent to adopt the rule in November 2024.
