Todd County (CSAH 16 Turtle Creek Crossing) - 401 Water Quality Certification
We invite you to comment on the draft 401 Water Quality Certification for the CSAH 16 Turtle Creek Crossing.
Todd County proposes to replace a failing bridge that crosses over Turtle Creek (stream ID 07010108-513). To comply with minimum State Aid Roadway design standards, the applicants must widen the road, which requires fill in wetlands and part of Turtle Creek. The aquatic resource impacts are as follows:
· Turtle Creek
· 1,887 square feet (sq ft) (255 linear feet) of permanent fill for the widened road
· 1,400 sq ft (100 linear feet) of permanent rip rap fill on both banks underneath the bridge
· 12,149 sq ft (375 linear feet) of permanent excavation for the realignment of the creek to the north
· 721 sq ft (66 linear feet) of temporary impacts from equipment disturbance
· Wetlands
· 12,810 sq ft of permanent fill for the widened road
· 5,287 sq ft of permanent excavation for the creek realignment
The wetland fill will be mitigated through the Local Government Road Wetland Replacement Program, and the wetland excavation will be mitigated by purchasing wetland bank credits at a 2:1 ratio. The permanent aquatic resource excavation is proposed to mitigate the public water fill.
The 401 Individual Water Quality Certification is part of the Federal 404 Clean Water Act (CWA) authorization process managed by the U.S. Army Corps of Engineers (USACE). The USACE cannot proceed with this project until MPCA finalizes its Individual Water Quality Request decision.
A 401 Water Quality Certification is required when an individual, business, or property owner proposes construction-related activities near a navigable lake, river, stream, or adjacent wetland. The MPCA reviews projects to ensure they will not violate Minnesota's more protective water quality standards. The 401 certification becomes an enforceable component of the associated federal license or permits issued under the Clean Water Act.
