NPDES and SDS General Feedlot Permits
We invite you to comment on the draft general National Pollutant Disposal Elimination System (NPDES) feedlot permit and draft general State Disposal System (SDS) feedlot permit.
The NPDES and SDS general feedlot permits are nearly identical. NPDES permits are required for any animal feedlot facility that discharges to waters of the United States and meets or exceeds any one of the federal thresholds for a large, confined animal feeding operation. An SDS permit is required for any animal feedlot facility that is capable of holding 1,000 or more animal units. Animal feedlots that are required to obtain an SDS permit may choose to obtain an NPDES permit in lieu of the SDS permit.
Both NPDES and SDS permits require facilities to be designed, operated, and maintained to prevent discharge to waters. Operators are also required to land apply manure at agronomic rates, observe water setbacks, and maintain records of land application activities, including location, timing, and rate of application.
Because these permits are so similar, your comment will be considered during the final development of each permit to simplify the process, unless you specifically note otherwise.
The MPCA issues feedlot permits to protect our lakes, rivers, streams, wetlands, and groundwater by preventing manure from polluting water. The permits apply to most aspects of livestock management including the location, design, construction, operation, and management of feedlots and manure handling facilities. Minnesota has approximately 17,000 registered livestock operations.
